These Terms of Service ("Terms") govern your access to and use of the Formalith website and related services operated by Formalith Architectural Materials Sp. z o.o.. By using our site, creating an account, submitting a quote request, or placing an order, you agree to these Terms.
Agreement to these Terms
These Terms form a binding agreement between you and Formalith Architectural Materials Sp. z o.o.. If you use Formalith on behalf of a company or other organisation, you represent that you have authority to bind that organisation to these Terms.
If you do not agree to these Terms, you must not use our website or services. Your use of specific features may also be subject to additional terms presented at the point of use.
Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or enter into a purchase agreement through Formalith.
Our services are available to individual consumers (B2C) and business customers (B2B). Business accounts may require valid company information, including a VAT number where applicable.
Accounts and registration
You may register for an individual or company account using the details requested in our registration form. You agree to provide accurate, current, and complete information and to keep your account details up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at contact@formalith.com if you suspect unauthorised access.
We may offer optional sign-in through Google in the future. If available, use of that feature will be subject to these Terms and any additional sign-in terms we publish.
You may update your profile, manage addresses, and upload an optional avatar through your account settings. You may request account deletion through your account or by contacting us, subject to our Privacy Policy and legal retention obligations.
Products, pricing, and availability
Formalith offers architectural materials and related products for sale through our website. Product descriptions, images, specifications, and samples are provided for information and may vary slightly from finished goods due to natural material characteristics.
Prices may be displayed in EUR, USD, or PLN according to your selected currency preference. Applicable taxes, shipping, duties, and other charges will be shown or communicated during checkout or in your order confirmation where relevant.
We reserve the right to modify product listings, pricing, and availability at any time. Errors in pricing or product information may be corrected, and we may cancel or refuse orders affected by such errors.
Custom trim quotes
You may request a custom trim quote by submitting the quote form, with or without an account. Quote requests may include measurements, material selections, project details, and file uploads.
A quote provided by Formalith is an estimate based on the information you supply. It is not a binding offer until confirmed in writing and accepted according to our order process. We may contact you for clarification before preparing or revising a quote.
You are responsible for the accuracy of information and files you submit. Formalith is not liable for delays or inaccuracies resulting from incomplete or incorrect quote information.
Orders, cart, and wishlist
You may add products to your cart and wishlist while browsing. Guest cart and wishlist data may be stored locally in your browser; signed-in customers may also have this data stored on our systems so it can be accessed across devices.
Placing an order constitutes an offer to purchase subject to acceptance by Formalith. We may accept, reject, or cancel orders for reasons including product availability, pricing errors, suspected fraud, or compliance requirements.
Order confirmation does not guarantee shipment until payment is received and the order is processed. Risk of loss and title for products pass to you according to the delivery terms communicated at checkout or in your order documentation.
Wishlist and cart features are provided for convenience and do not reserve inventory.
Contact and support cases
You may contact us through our contact form, email, or other channels we make available. Contact submissions may be made as a guest or while signed in to your account.
Support cases may include attachments such as images or documents. You must not submit unlawful, offensive, or infringing content. We may use case information to investigate and resolve your enquiry in accordance with our Privacy Policy.
We aim to respond to enquiries within a reasonable time but do not guarantee a specific response period unless agreed separately in writing.
Acceptable use
You agree to use Formalith only for lawful purposes and in accordance with these Terms. You must not misuse our website, accounts, or services.
Prohibited conduct includes attempting to gain unauthorised access to our systems or other users' accounts, interfering with site security or performance, scraping or harvesting data without permission, submitting false or misleading information, uploading malware or harmful files, or using our services in violation of applicable law.

We grant you a limited, non-exclusive, non-transferable licence to access and use the site for personal or internal business purposes related to browsing, quoting, and purchasing our products. You may not copy, modify, distribute, sell, or create derivative works from our content except as permitted by law or with our prior written consent.
If you upload content to Formalith, such as quote attachments or support files, you grant us a licence to use that content as needed to provide our services. You represent that you have the rights to submit such content.
Third-party services
Formalith relies on third-party services to deliver the website, including Cloudflare for hosting and content delivery and an email delivery provider for transactional communications.
If we enable optional Google sign-in, your use of that feature will also be subject to Google's applicable terms and policies. Third-party services are not controlled by Formalith, and we are not responsible for their independent practices except as described in our Privacy Policy.
Disclaimers and limitation of liability
Formalith provides the website and services on an "as is" and "as available" basis to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.
Product images and descriptions are for general reference. Natural stone and architectural materials may vary in colour, texture, and dimensions. You are responsible for verifying suitability for your project before ordering.
To the maximum extent permitted by law, Formalith shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities arising from your use of the site or products, except where liability cannot be excluded under applicable law.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded by law.
Suspension and termination
We may suspend or terminate your access to Formalith, or cancel orders, if we reasonably believe you have violated these Terms, pose a security risk, or if required by law.
You may stop using our services at any time and may request account deletion as described in our Privacy Policy. Provisions that by their nature should survive termination—including intellectual property, disclaimers, limitation of liability, and governing law—will continue to apply.
Governing law and disputes
Formalith primarily serves customers in the European Union. These Terms are governed by the laws of the Republic of Poland, without prejudice to mandatory provisions of European Union law and, where applicable, the mandatory consumer protection rules of your country of residence.
If you are a business customer, disputes arising from these Terms or your use of Formalith shall be submitted to the competent courts in Poland, unless mandatory law requires otherwise.
If you are a consumer in the European Economic Area or the United Kingdom, you benefit from any mandatory protections available in your country of residence. You may bring proceedings in the courts of your place of residence where EU or national law gives you that right.
The European Commission provides an Online Dispute Resolution platform for consumers in the EU: https://ec.europa.eu/consumers/odr/. We are not required to participate in alternative dispute resolution before a consumer arbitration body, but we will review complaints sent to us directly in good faith.
Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, provide notice on our website.
Your continued use of Formalith after updated Terms take effect constitutes acceptance of the revised Terms, except where applicable law requires your explicit consent.
